Currently, we are looking for a Contracts manager with a Rail engineering project background to join our team on a perm basis. This role is hybrid and may involve some site visits with our clients. This role will require 3 days per week in our 130 Adelaide street office.
The Contracts Manager ensures that proper contract procedures are implemented, administered and maintained in accordance with the company’s policies and procedures and the specific project requirements.
You will provide support to Design Engineers Project Managers, Project Director, Commercial Directors, Legal Counsel in all areas of contracts administration. This is a new role to an existing team.
Responsibilities:
· Monitor and foster compliance to contractual requirements by consulting with the project delivery team
· Contribute to the development and implementation of any risk mitigation plan, including the drafting of formal project communications
· Must front face with clients and liaise with them on all matters related to contracts
· Review, draft, and negotiate end customer & supplier agreements
· Lead, in tandem with other colleagues (e.g., Sales, Procurement, etc.), the development of contractual arrangements between the company and its customers or suppliers
· Advise on contractual structures and risks emanating from the envisioned transaction
· Ensure that project delivery interests are being advanced and coordinate inputs from support functions within company (e.g., Finance, Insurance, etc.) with emphasis on infrastructure-type and technology contracts
· Manage contract change order process
· Proactively work to ensure that contract requirements for realizing change orders are submitted in a timely fashion and contain all required information, including sufficient supporting documentation
· Lead the management of claims, including but not limited to those associated with out-of-scope work and extension of time, in consort with internal stakeholders (e.g., Project Manager, executive management, etc.) by ensuring that all required contractual steps are professionally managed
· Add value through the planning, execution, and/or supervision of contract management.
· Document contractual milestones, notifications of potential effects or impacts from third parties, and all aspects that could lead to a future claim from the client, subcontractors, or partners.
· Ensure that notifications of potential impacts received from third parties and all events that could lead to a future claim from the client, subcontractors, or partners are available.
· Maintain an adequate record of contractual milestones to document claims.
· Establish a proactive mechanism to identify potential problems in the project, report them appropriately, and try to avoid or minimize their impact before they occur. Early Warnings.
· Maximize the positive outcome for Sener from change orders and claims to Partners and Clients, and to other third parties when applicable (stakeholders).
· Minimize the application of penalties and Liquidated Damages (LD) for delays, lost profits, etc.
· By the Client and/or Partners, through the appropriate analysis of the contractual clauses and the definition of the necessary mitigation strategies.
· Monitoring the project's contractual status. Maintaining an up-to-date record of project variations and claims and managing them with the internal and external management team.
· Ensuring the generation and delivery of communications and documents related to the management of scope, deadlines, and other contractual matters, in terms of form, timelines, and content, as required by the Contract or in response to communications and documents generated by the Client.
· Proposing actions to the Project Manager to protect SENER from changes that affect the contract. Working with the project management team (Project Manager, IRDs, Planning, Project Control, Document Control, IPs, etc.) to communicate contractual risks and the current status so that all stakeholders can work together to ensure proper compliance with contractual requirements
· Escalating identified risks and opportunities to Operations Management
· Manage the main contract with the client counterpart
· Govern the contract in conjunction with the Project Manager
· Manage subcontracts in conjunction with the Project Managers
· Draft the Contract Kickoff Meeting minutes in conjunction with the Project Manager
· Implement the Contract Management Procedure in conjunction with the Project Manager
Requirements:
Must have 10 plus years of experience in contract management
Minimum of 10-12 years of experience administering / negotiating / managing contracts
Must have both client and supplier experience
Experience in the Rail or large Civil project industry preferred
Strong interpersonal, communication and negotiation skills, including the ability to deal professionally with difficult individuals and problematic situations
Engineering background is a plus but not mandatory
Must be an Initiative-taking individual capable of working independently with minimal supervision, who is also a team player
Must have the ability to comprehend and understand requirements, company policies particularly pertaining to contracts, insurance, bonding, and risk management
Fluency in other languages like French and Spanish an asset but not mandatory
Experience working on large projects in Rail and Infrastructure is mandatory
Engineering background is not mandatory but an asset
